However, a new bill, Measure S1602, aims to reduce distracted driving by making it against the law to text while at a stoplight, too. In fact, New Jersey lawmakers have introduced a measure that makes simply holding a cell phone, as a driver, a disorderly person offense. What Are the Penalties for Texting and Driving in New Jersey?

New Jersey has expanded their definition of distracted driving due in part to a desire to qualify for the federal Distracted Driving Grant Program, a federal grant given to states to help deter distracted drivers. The expanded statutes can come with stiff penalties, similar to those from a DWI or DUI infraction.

Distracted driving caused nearly 1,400 accidents, including one fatality, in 2018. Therefore, penalties for this can include a fine of $200 to $400 for a first offense and $400 to $600 for a second offense. A third violation would result in an $800 fine and license suspension for up to three months.
